Terms and Conditions of Use

These terms and conditions (“Terms”) govern the use of the various online products, games, applications and other services (the “Services”) made available to users (“you”, “your”) by TutoToons Limited and its subsidiaries and affiliates (“we”, “our” or “TutoTOONS”).

Please read these Terms carefully before using the Website or subscribing to the Service. Only parents or legal guardians are permitted to create and manage a TutoClub subscription account. By subscribing to TutoClub and clicking a box or link indicating your acceptance of these Terms, you agree to be bound by them. If you do not agree with these Terms, in whole or in part, you may not use the Website or the Service.

1.1. All information, materials, functions and other content and applications (“Content”) in or on our Services, as well as all trademarks, service marks, trade names or any other intellectual property, are owned and controlled by us or our licensors.

1.2. The Content is licensed to you solely for your personal, non-commercial use in accordance with these Terms. You may not copy, reproduce, distribute, modify, or create derivative works from the Content without our prior written consent.

1.3. We reserve the right to update, modify, or remove any Content or features at any time, with or without notice.

1.4. Nothing in these Terms transfers to you or any third party any ownership rights in the Content or in any intellectual property associated with tutoclub.com or TutoClub.
2.1. You are granted a limited, non-exclusive, non-transferable licence to use tutoclub.com and the TutoClub subscription strictly in accordance with these Terms.

2.2. The Content is provided for personal, non-commercial use only. You may not copy, edit, transmit, distribute, sell, rent, or create derivative works from any Content, except as expressly permitted under these Terms.

2.3. Where TutoClub or the Website allows the downloading of Content, you may download one copy to a single device for personal use only, provided you do not modify or redistribute it.

2.4. Only parents or legal guardians may create and manage a TutoClub subscription account. Children may use the Service and access Content only under the supervision and responsibility of a parent or guardian.

2.5. You must not use tutoclub.com or TutoClub for any unlawful or commercial purposes.

2.6. We reserve the right to restrict or suspend access to all or part of TutoClub at our discretion. You must not attempt to bypass any access or security restrictions.

2.7. We do not guarantee that any Content or features will always be available, or that specific games or functions will remain accessible for a particular period. We reserve the right to update, change, or remove Content and features without notice. Updates may affect how the Service operates, including game functionality. We are not liable for any resulting changes or loss of progress.
3.1. You must not use tutoclub.com or TutoClub in any way that:
3.1.1. causes, or may cause, damage to the Website or Service, or interferes with their performance or availability;
3.1.2. is unlawful, fraudulent, harmful, or connected with any harmful or illegal activity;
3.1.3. involves transmitting malware, spyware, viruses, Trojan horses, worms, keyloggers, rootkits, or any other malicious software;
3.1.4. uses automated tools such as bots, scrapers, or data-harvesting programs without our prior written consent.

3.2. You must ensure that all information you provide to us through tutoclub.com or TutoClub is accurate, current, complete, and not misleading.

3.3. Only parents or legal guardians may create and manage a TutoClub subscription. Children may use the Service only under the supervision of their parents or guardians. Parents/guardians are responsible for ensuring their children follow these Terms.
4.1. We do not guarantee that:
4.1.1. The information provided on tutoclub.com or within TutoClub will always be complete, accurate, or up to date;
4.1.2. The content will always be available, or
4.1.3. iThe Service will be uninterrupted, error-free, or free from defects.

4.2. We reserve the right to change, update, suspend, or discontinue all or part of tutoclub.com or TutoClub at any time, at our sole discretion and without notice. Except where required by law, you are not entitled to compensation if the Website or Service is changed, suspended, or discontinued.

4.3. To the maximum extent permitted by law, we exclude all warranties, representations, or conditions relating to tutoclub.com, TutoClub, or the Content.

4.4. Your use of the Website and the Service is at your own risk. TutoClub and any third-party services are provided “as is” and “as available,” without warranties of any kind, either express or implied, unless such warranties cannot legally be excluded.

4.5. Nothing in these Terms affects your statutory rights as a consumer under applicable law. Suppose you are a resident of the United Kingdom or a member state of the European Union. In that case, you may have additional rights under local consumer protection laws, which will prevail in the event of a conflict with these Terms.
5.1. Where tutoclub.com or TutoClub is provided free of charge (such as during free trials or promotions), we will not be liable for any losses or damages unless required to do so by law.

5.2. Our total liability to you for any claim arising out of or in connection with your use of tutoclub.com or TutoClub will be limited to the total amount you have paid for your TutoClub subscription in the twelve (12) months immediately preceding the event giving rise to the claim.
6.1. TutoClub is a paid subscription service that offers exclusive access to a curated selection of TutoTOONS games, free from ads and in-app purchases.

6.2 TutoClub is currently offered worldwide through the Apple App Store, Google Play Store, and Amazon.

6.3 Only parents or legal guardians may create and manage a TutoClub subscription account. By subscribing, you agree to provide accurate account and payment details. For information on how we process personal data, please refer to our Privacy Policy.

6.4 By creating a TutoClub account, you may agree to receive newsletters or promotional emails. You can unsubscribe at any time by following the instructions included in those communications.

6.5 TutoTOONS sets subscription fees and reserves the right to change them at our discretion. The price applicable at the time of purchase will remain in effect for the duration of the current billing period.

6.6 Subscriptions are subject to the payment terms and conditions of the platform (for example, Apple App Store or Google Play Store) from which the purchase is made. You agree to pay all fees and applicable taxes incurred by you or by anyone using your account.

6.7 A TutoClub subscription provides access on up to three devices, or more if family sharing is enabled, subject to the platform's terms and conditions.

6.8 Each game must be downloaded separately from the App Store or Google Play Store. If your subscription is active, your TutoClub login will unlock premium content and remove ads within eligible games.

6.9 Subscriptions renew automatically unless cancelled through the relevant app store. Uninstalling a game does not cancel your subscription—you must cancel directly through the app store. Cancellation takes effect at the end of the current billing period. No refunds are issued for unused time, but you will retain access until the end of the cycle.

6.10 If you start a free trial, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

6.11 If you subscribe to the TutoClub “Family Sharing” plan, you may invite family members to access the games on their devices, subject to platform rules and device limits. 6.12 We may revise subscription fees at any time. Any change will apply in accordance with the payment terms of the platform used for purchase.

6.13 We may suspend or terminate your subscription if you fail to comply with these Terms or with any special terms applicable to a particular service.
7.1 Purchases of TutoClub subscriptions made through the TutoTOONS Online Shop at www.tutoclub.com are processed by TutoTOONS Limited, registered at Torridon House, Beechwood Park, Inverness, Scotland, IV2 3BW. By placing an order, you enter into a binding contract with TutoTOONS Limited based on these Terms.

7.2 Only parents or legal guardians aged 18 or over may purchase a TutoClub subscription. By placing an order, you confirm that you have the legal right to make purchases on the Platform.

7.3 To ensure tax compliance, purchases through the Platform are available only to customers located in the United States, the United Kingdom, Canada, Australia, and the European Union. Customers in other countries may access TutoClub through alternative purchase methods.

7.4 You must create an account on the Platform to purchase a TutoClub subscription. During registration, you must provide accurate and complete information and keep your login details (email and password) secure. You are responsible for all activity carried out under your account. If you lose your login details or believe they have been compromised, you must notify us immediately at [email protected].

7.5 Subscription plans are available as monthly, annual, or lifetime options. Prices are displayed in Euros (EUR) and are exclusive of taxes. Our payment provider calculates applicable taxes based on your location, as determined by your billing address, IP address, and payment method information.

7.6 Payments are processed securely by Stripe. You may pay using debit or credit cards (such as MasterCard, VISA, and VISA Electron) or other supported methods in your region (e.g., digital wallets, bank transfers). TutoTOONS does not store or access your payment details. Responsibility for secure payment processing lies with Stripe as the certified provider.

7.7 A subscription order is confirmed and activated once payment has been received. You will receive confirmation of your order and payment by email. You may also track your subscription status through your account on the Platform. If payment is not received, the order will be automatically cancelled.

7.8 Invoices are issued electronically upon request and delivered to the email address you provide. If an invoice is requested in the name of a company or organisation, it will be issued within three (3) business days of payment.

7.9 For new customers, a free trial of three (3) days is available. Unless cancelled before the trial ends, the subscription will automatically convert to the chosen paid plan (monthly, annual, or lifetime), and the applicable fee will be charged. If you cancel during the free trial, no charges will apply.

7.10 Subscriptions offer access to premium features in select TutoTOONS games. The subscription is provided exclusively for leisure and personal, non-commercial use. All games and digital materials remain the exclusive property of TutoTOONS. You may not sell, copy, exchange, transfer, publish, rent, license, distribute, or otherwise commercially exploit them.

7.11 Except as set out in Clause 7.9 or required by consumer law, subscription fees are non-refundable once a billing period has started. If you request deletion of your personal data, your subscription will be cancelled immediately, but no refund will be given for payments already made.

7.12 Under UK law (Consumer Contracts Regulations 2013) and similar EU consumer laws, you usually have the right to cancel distance contracts within 14 days of purchase. This right does not apply to digital content once access has started with your express consent and acknowledgement that the right is lost. By subscribing to TutoClub, you expressly agree that access begins immediately and that you therefore waive the statutory right to withdraw once your subscription starts.

7.13 If TutoTOONS is unable to provide the subscription service for an extended period through no fault of yours, refunds will be issued as follows:
7.13.1 For monthly or annual subscriptions: a refund for the unused portion of the subscription period.
7.13.2 For lifetime subscriptions: a full refund of the purchase price. Refunds will be processed within fourteen (14) days via Stripe using the original payment method.

7.14 If you delete your account or request deletion of your personal data, we will no longer retain your purchase history. Access to your subscription will end, and services will not be restored if you create a new account in the future.

7.15 We reserve the right to change subscription prices at any time. Any change will apply from the start of your next billing period, unless otherwise required by law.

7.16 We may send you notices or information about your subscription by email or phone to the contact details you provide. You must keep your contact details up to date.

7.17 These Terms are governed by and construed in accordance with the laws of the United Kingdom. Disputes will first be resolved by negotiation, and if unresolved, by the exclusive jurisdiction of the UK courts. If you are a consumer residing in the EU, you may also bring claims in the courts of your place of residence.

7.18 Subscription fees, billing terms, cancellations, free trials, and refund rules are subject to the applicable platform’s terms and to our Purchasing Terms. Please review these carefully before subscribing.
8.1. If you breach these Terms, or if we reasonably suspect that you have done so, we may take one or more of the following actions:
8.1.1 issue a formal warning;
8.1.2 temporarily suspend your access to tutoclub.com or TutoClub;
8.1.3 permanently terminate your subscription or access to the Service;
8.1.4 take legal action against you to enforce our rights.

8.2. If your access has been suspended or terminated, you must not attempt to bypass or circumvent that restriction.
9.1 The Website may include links to third-party websites, including advertisers or content providers. These links are provided for your convenience only and should not be considered endorsements. We do not control and are not responsible for the content of third-party websites. Your use of such websites is at your own risk, and we are not liable for any loss or damage arising from it.

9.2 We may update or revise these Terms from time to time, with the latest version previously published on tutoclub.com. Continued use of the Website or Service after publication means you accept the revised Terms.

9.3 We may assign, transfer, or subcontract our rights and obligations under these Terms without restriction. You may not assign or transfer your rights or obligations without our prior written consent.

9.4 If any part of these Terms is found unlawful or unenforceable, the remaining provisions will remain in effect. If only part of a provision is illegal, that part will be deleted while the rest remains valid.

9.5 These Terms are for the benefit of you and us only and are not intended to grant rights to any third party. Their enforcement does not require the consent of a third party.

9.6 Together with our Privacy Policy. and Purchasing Terms., these Terms constitute the entire agreement between you and us, superseding any prior agreements related to the Service.

9.7 These Terms are governed by and construed in accordance with the laws of the United Kingdom (Scotland). Disputes will be resolved exclusively in the courts of Scotland, except that if you are a consumer residing in the UK or EU, your local mandatory consumer rights and jurisdiction will prevail.

9.8 If you become aware of unlawful material, misuse of TutoClub, or an activity that breaches these Terms, please contact us at [email protected]. We will review your report and take appropriate action.
